Moore v. Texas

5-3 Supreme Court ruling that Texas used unconstitutional standards in determining that a death row inmate was not intellectually disabled.  The court had previously ruled in a Virginia case (Atkins v. Virginia) that executing the “mentally retarded” violated the Constitution’s prohibition against cruel and unusual punishment.  That decision left it up to states to determine their own guidelines for intellectual disability.  From the Legal Information Institute of the Cornell University Law School
