2-1 decision of a panel of the 4th Circuit Court of Appeals in Richmond that the Virginia law which outlaws what is termed partial birth infanticide as an abortion method is unconstitutional. The judges found the Virginia law to be more restrictive than the federal ban on late-term abortion that the U.S. Supreme Court approved in Gonzales v. Carhart last year.
